General terms of use
XM Mobility, publisher of the website XM-Mobility.fr, offers a passenger transport booking service in Paris and the Île-de-France region.
Any reservation made on the XM-Mobility.fr website implies full and unreserved acceptance of these General Terms and Conditions of Use by the customer.
These terms and conditions apply automatically to all bookings made via the website, unless otherwise agreed in writing by XM Mobility. They supersede any other terms and conditions stipulated by the customer.
By confirming an online booking, the customer acknowledges having read these conditions and agrees to be fully bound by them.
Booking rules
Flat rates apply when the requested journey corresponds to an existing flat rate. In this case, the flat rate can be applied to the booking.
Responsibilities of the passenger/customer
Smoking is strictly prohibited inside vehicles, as is transporting animals, except with prior agreement. The transport of explosive, corrosive, hazardous, toxic, or flammable substances is also prohibited.
Failure to comply with these rules may result in the passenger-customer being held liable and XM Mobility reserves the right to take any appropriate legal action.

Any delays due to unforeseen traffic conditions beyond the control of XM Mobility will not give rise to any compensation.
The passenger-customer agrees to adopt respectful behavior towards the driver and the vehicle.
Any damage caused to the vehicle, whether intentional or not, may be billed to the passenger-customer to cover the costs of repair, cleaning or immobilization of the vehicle.
In the event of inappropriate, dangerous, or disrespectful behavior, the driver reserves the right to immediately terminate the ride. In this case, the passenger will still be liable for the service, and no refund will be issued.
A reasonable waiting time is included when the passenger is picked up.
Beyond this period, a surcharge may be applied according to the applicable pricing conditions.
If the passenger-client is absent from the agreed meeting place and time, the reservation may be considered cancelled and the ride may be charged.
Any cancellation of a reservation must be made within a reasonable time before the scheduled pick-up time.
In the event of late cancellation or no-show by the passenger-customer, XM Mobility reserves the right to charge all or part of the amount of the reserved ride.
Furthermore, XM Mobility reserves the right to subcontract all or part of the transport services to drivers or partners selected by it.
Luggage and personal belongings transported in the vehicle remain the responsibility of the passenger-customer.
XM Mobility cannot be held responsible for the loss, forgetting, or damage of personal belongings left in the vehicle.
Personal data
The information collected on the XM-Mobility.fr website is intended exclusively for XM Mobility for the purposes of managing reservations, customer relations and improving the services offered.
The personal data collected is processed in a strictly confidential manner and is in no case sold, rented or transmitted to third parties without the prior consent of the user, except where legally required.

In this context, XM Mobility and all of its partners have insurance contracts taken out with companies recognized for their financial strength, covering all risks related to their activity, in accordance with the regulations in force.
These insurances cover, under professional civil liability, direct bodily injury, material and intangible damages that may be suffered by passengers during the entire duration of the transport service, from boarding the vehicle until the passenger disembarks, these two operations being included.
However, this guarantee cannot apply to damages resulting from fault, negligence or conduct attributable to the customer.
Applicable law
These terms and conditions are governed by French law.
In the event of a dispute, the parties will endeavor to find an amicable solution before any legal action.
